The EU Court of Justice has annulled the European Commission delegated regulation of 2019, which labeLled titanium dioxide (TiO2) as a carcinogenic substance by inhalation in certain powder forms.

This is said to be due to a ‘manifest error in its assessment’ of the data.

The requirement to base the carcinogenic classification on reliable and acceptable studies was not satisfied.

It is unsure, at yet, how this will affect classification for titanium dioxide in Great Britain and clarification will be given in due course.
